China Sets Up Anti-Monopoly Commission

The National Anti-Monopoly Commission was set up on Friday to better enforce China's first anti-monopoly law to uphold fair competition.

The new coordination body is directly under the State Council. The National Development and Reform Commission, Ministry of Commerce and the State Administration for Industry and Commerce have taken part of the responsibilities of the new commission.

The announcement came after the anti-monopoly law took effect on Friday. The law, dubbed the "constitution for the market economy", was first proposed 15 years ago but was not passed until last year. (查看全文)

How To Write The Document Of Entrustment

 The document of entrustment is the most usefully document in daily life. The China’s law regulated that an agent shall perform civil juristic acts in the principal's name within the scope of the power of agency. The principal shall bear civil liability for the agent's acts of agency. The article 65 of  GENERAL PRINCIPLES OF THE CIVIL LAW OF THE PEOPLE'S REPUBLIC OF CHINA regulated that　＂Where the entrustment of agency is in writing, the power of attorney shall clearly state the agent's name, the entrusted tasks and the scope and duration of the power of agency, and it shall be signed or sealed by the principal＂. In simple terms, a effective entrustment document shall have 4 point: who(the principal’s name),what(the agent’s tasks),when(the duration of the entrustment) and how(the agent’s scope of entrust ).    Write a formal entrustment document is very important, cause If the power of attorney is not clear as to the authority conferred, the principal shall bear civil liability towards the third party, and the agent shall be held jointly liable.Hereafter, I’ll give the formally format aim at two different agents---attorney and citizen 　　                                          GENERAL POWER OF ATTORNEY         I,  name   ,of   address      ,hereby appoint  agent’s name   ,of    the law firm’s name      ,as my attorney in fact to act in my capacity to   the agent’s task      that I may legally do through an attorney in fact.
